Please review these Terms carefully before downloading or using SnapMuse. If you do not agree with any portion of these Terms, or if anything is unclear, please refrain from using our Services.

User-Generated Content

You are solely responsible for any content you create, upload, transmit, or share through our Services—including videos, messages, and other media ("User Content"), whether shared publicly or privately. You retain full ownership of your User Content. All media generated using our Services is saved locally on your device and is not uploaded to or stored on our servers.

You agree to use the Services in compliance with all applicable laws and regulations. Your User Content must not:

A. Infringe upon the rights of any third party, including intellectual property, privacy, confidentiality, or publicity rights;

B. Violate any local, national, or international laws or regulations;

C. Contain material that is offensive, abusive, defamatory, discriminatory, violent, obscene, pornographic, or promotes unlawful or harmful behavior;

D. Encourage, promote, or assist in any illegal or dangerous acts;

E. Identify or depict any individual without their explicit consent—or, in the case of minors, without verifiable parental or guardian consent;

F. Share personal contact information or invade another individual’s privacy;

G. Contain malicious software, viruses, or other harmful code.

Prohibited Activities

You agree not to:

A. Use the Services or any User Content in ways inconsistent with these Terms or beyond the intended scope of the Services;

B. Use the Services for any unlawful, unauthorized, or fraudulent purposes;

C. Interfere with, disrupt, damage, or impair the normal functioning of the Services or related systems and networks;

D. Employ automated tools or manual methods (e.g., bots, scrapers, spiders) to extract data or manipulate the Services;

E. Copy, alter, reverse-engineer, decompile, or disassemble any part of the Services;

F. Embed, integrate, or repackage the Services within any other product or application;

G. Upload or distribute viruses, malware, or harmful code;

H. Infringe on SnapMuse’s intellectual property rights or those of others.

General Terms

These Terms constitute the entire agreement between you and SnapMuse concerning the use of our Services and supersede any prior agreements, written or oral. We reserve the right to assign these Terms or any rights and obligations hereunder without notice.

Failure by either party to enforce any provision will not constitute a waiver of that or any other right. If any part of these Terms is held to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

SnapMuse is not responsible for delays or failures in performance resulting from events beyond our reasonable control, including but not limited to natural disasters, acts of war or terrorism, labor disputes, or governmental actions.

We reserve the right to pursue all available legal remedies, including injunctive relief, to protect our intellectual property and confidential information without the need to post bond.

Third-Party Services

Our Services may contain links to or integrations with third-party platforms (e.g., Facebook, Instagram). We do not control or endorse these third-party services and are not responsible for their content, availability, or practices. Your use of such services is governed by the respective third party’s terms and policies. We do not collect or store your login credentials or personal data used on those platforms.

Indemnification

You agree to indemnify, defend, and hold harmless SnapMuse and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

Your use or misuse of the Services;

Your User Content;

Your violation of these Terms or applicable law;

Any breach of third-party rights, including intellectual property or privacy rights.

Disclaimer and Limitation of Liability

Unless expressly stated otherwise, SnapMuse and its affiliates disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted operation. Any warranties implied by law are limited to the maximum extent permitted.

In no event shall SnapMuse or its affiliates be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use of the Services, even if advised of the possibility of such damages.

Advertising

As part of the user experience, SnapMuse may display advertisements within the Services. These advertisements may be served by us or third-party providers in accordance with our Privacy Policy.

Copyright and Intellectual Property

SnapMuse respects the intellectual property rights of others and expects users to do the same. We promptly investigate credible claims of copyright infringement and will take appropriate action, which may include content removal or account termination, in accordance with applicable intellectual property laws, including the Digital Millennium Copyright Act (DMCA).

Governing Law and Dispute Resolution

If a dispute arises between you and SnapMuse, we encourage you to contact us first to seek an informal resolution. If the matter cannot be resolved, it will be governed by the dispute resolution procedures set forth by Google Play.

These Terms are governed by the laws of the State of California, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in California for any disputes arising out of or relating to these Terms or your use of the Services. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
